Adelaide Pointe Marina – Terms of Use

Welcome to Adelaide Pointe Marina. By accessing or using our facilities, services, website, or engaging in any marina-related activities, you agree to comply with and be bound by the following Terms of Use. Please read these terms carefully.
1. Acceptance of Terms
By entering, docking, or otherwise using Adelaide Pointe Marina and its associated services (the “Marina”), you acknowledge that you have read, understood, and agree to these Terms of Use, our Privacy Policy, and any additional guidelines or rules posted at the Marina or on our website.
2. Use of Facilities
Eligibility: Use of our facilities is intended for recreational boating and related activities. You must be at least 18 years old to reserve a slip or enter into any service agreement.
Permitted Use: All vessels must be operated safely and responsibly. Commercial activities, overnight charters, and subleasing slips are prohibited without prior written approval.
Compliance: All users must comply with marina rules, posted signage, state and federal boating laws, and Coast Guard regulations.
3. Slip Rental & Payment
Slip Assignments: Slip locations are assigned by Marina staff and may be changed at any time for operational reasons.
Fees: All fees must be paid in full in accordance with the posted rate schedule. Failure to pay may result in termination of access and removal of the vessel at the owner’s expense.
Cancellations: Refunds for slip rentals are subject to Marina cancellation policies and timelines.
4. Conduct & Safety
Noise & Behavior: Disorderly conduct, excessive noise, or any behavior that interferes with the peaceful enjoyment of the Marina by others is prohibited.
Pets: Pets are welcome but must be leashed and cleaned up after.
Alcohol & Drugs: Public intoxication and illegal substances are strictly prohibited on marina property.
5. Liability & Indemnity
User Responsibility: Users are responsible for their own actions and the actions of their guests. You agree to indemnify and hold harmless Adelaide Pointe Marina, its owners, employees, and affiliates from any claims or damages arising from your use of the Marina.
Limitation of Liability: The Marina is not liable for loss, theft, or damage to vessels, personal property, or injuries occurring on the premises, except where required by law.
6. Termination of Access
We reserve the right to revoke access to the Marina at any time for violation of these terms or any behavior deemed unsafe or disruptive.
7. Modifications to Terms
Adelaide Pointe Marina reserves the right to update or modify these Terms of Use at any time. Continued use of the Marina constitutes acceptance of those changes. The most current version will always be posted at the Marina office and on our website.
8. Privacy Policy
Use of our website and services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan. Any disputes arising from these terms shall be resolved in the appropriate courts of Muskegon County, Michigan.
